For the division of a building into “apartment rights”, you will need a civil-law notary. The division is required to sell a single room (condominium) in a building. This is because the property with the thereon standing building has its own unique cadastral number, while the rooms inside of the building do not have their own (separate) cadastral numbers. Through the process of the division, the notary requests the public registry for a separate cadastral number specifically for this division into “apartment rights”. With the notarial deed of division into apartment rights, this process officializes. Thereon after these separate rooms/condos can be sold.
In the same deed of division, an Owners Association (Vereniging van Eigenaars) is also incorporated. Each buyer/owner is automatically a member of this association. With this membership, every owner has a say and therefore control over matters that concern the building and is liable for certain costs, such as maintenance.
For the division into apartment rights, it is advisable to engage an architect for the necessary drawings. The architect can help you chart each room that needs a separate number. We recommend that the drawing(s) are checked first for formal requirements at the Land Registry before we proceed with the request for the (complex) numbers.
