By law a cohabitation agreement is not mandatory. However, it can be of great value to cohabitants. The law has not arranged anything for them.
In a cohabitation agreement, cohabitants agree with each other that they will run a common household and have an obligation to take care of each other, whereby they wish to make arrangements regarding their finances and joint assets, for now and for in the future. This sounds complicated, but it determines, for example, which assets and liabilities belong to whom, what is agreed with regard to each other's pension, other payments to each other, costs of housekeeping, insurances and often more agreements can be made.
A cohabitation agreement will however not give you any civil status that will be registered at the population registry (“Censo”).
